Terms & Conditions

About this policy

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("you," "your," or "Patient") and Ongo Weight Loss, together with its affiliates, licensed clinical partners, and service providers ("Ongo," "we," "us," or "our"). These Terms govern your access to and use of the Ongo website, mobile experience, online intake and consultation platform, and all related content, tools, and services (collectively, the "Services"). By creating an account, completing an intake form, booking a consultation, or otherwise accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Refund Policy, and any other policies referenced herein (together, the "Policies"). If you do not agree to these Terms, you must not access or use the Services.

Description of Services

1.1 What Ongo Provides

Ongo operates an online platform that connects patients with independent, licensed healthcare providers ("Providers") for virtual evaluation and, where clinically appropriate, ongoing management of weight-related conditions, which may include evaluation for GLP-1 receptor agonist medications and other treatments.

1.2 What Ongo Does Not Provide

  • Ongo is not a pharmacy, does not manufacture medication, and does not practice medicine.
  • Ongo does not guarantee that any consultation will result in a prescription, referral, or specific treatment outcome.
  • Clinical decisions, including whether to prescribe, decline to prescribe, or discontinue any medication, are made solely by the independent, licensed Provider who evaluates you, exercising independent professional judgment.

1.3 Fulfillment

If a Provider issues a prescription, it is transmitted to and fulfilled by a licensed, independent third-party pharmacy ("Pharmacy Partner"). Ongo assists with coordination, billing, and customer support related to fulfillment, but the Pharmacy Partner is solely responsible for dispensing, packaging, and shipping medication in compliance with applicable law.

Eligibility

  • You must be at least 18 years old and capable of forming a binding contract to use the Services.
  • You must be located in a jurisdiction where the Services and any prescribed medication are legally available at the time of your consultation.
  • You agree to provide true, accurate, current, and complete information during registration, intake, and every subsequent interaction, and to promptly update that information if it changes.
  • Eligibility for any consultation, prescription, or treatment plan is determined solely by a licensed Provider based on independent clinical judgment. No specific outcome, prescription, or treatment is promised or guaranteed by Ongo.
  • Ongo reserves the right to refuse, suspend, or discontinue Services to anyone for any lawful reason, including suspected misrepresentation, fraud, or misuse.

Medical Disclaimer & No Guarantee of Results

  • All content on the Ongo website and platform — including articles, FAQs, product descriptions, and marketing materials — is provided for general informational and educational purposes only and does not constitute medical advice.
  • Nothing on the Services should be used as a substitute for the independent medical judgment of a licensed Provider who has evaluated you directly.
  • Individual results from any treatment, including GLP-1 medications, vary significantly based on medical history, adherence, lifestyle, metabolism, and other individual factors. Ongo makes no guarantee, warranty, or representation regarding weight loss outcomes, timeframes, or side effects.
  • Testimonials, reviews, and before/after depictions reflect individual experiences and are not indicative of results any specific user will achieve.
  • Compounded medications, when offered, are not FDA-approved and have not been evaluated by the FDA for safety, efficacy, or quality; they are prescribed and dispensed only where permitted by law and deemed appropriate by your Provider.

Third-Party Pharmacy Fulfillment & Shipping

  • Prescriptions, if issued, are dispensed and shipped exclusively by licensed, independent Pharmacy Partners in accordance with applicable state and federal law.
  • Shipping timelines, packaging, cold-chain handling (where applicable), carrier selection, and related logistics are determined by the Pharmacy Partner, not Ongo.
  • Ongo coordinates the fulfillment process on your behalf and remains available to assist with billing questions, shipping inquiries, delays, damage, or dispensing concerns, but does not itself dispense medication.
  • If you experience a delay, loss, damage, or dispensing discrepancy, contact Ongo at info@ongoweightloss.com so we can coordinate directly with the Pharmacy Partner toward resolution.

See our separate Shipping Policy for additional detail.

Fees, Payment, Cancellations & Refunds

  • Consultation fees and any applicable platform charges are disclosed prior to booking and are due at the time of scheduling.
  • Once a consultation has been completed, consultation fees are non-refundable, as professional time has been rendered and reserved exclusively for you.
  • You may cancel or reschedule a consultation at least 24 hours in advance of the scheduled time; cancellations made within 24 hours may not be eligible for a refund except in cases of technical failure or extraordinary circumstances, reviewed case-by-case.
  • Medication charges are billed separately from consultation fees. Medication orders may be canceled or modified only before the prescription is transmitted to the Pharmacy Partner; once dispensed or shipped, medication charges are non-refundable except as required by law.
  • Ongo does not enroll patients in automatic recurring subscriptions unless clearly disclosed and affirmatively agreed to at the time of purchase.
  • We encourage you to contact us first at info@ongoweightloss.com so we can try to resolve any billing concern directly. You always retain the right to initiate a chargeback or payment dispute with your card issuer.

Full detail on refund eligibility and processing timelines is set out in our Refund Policy, which is incorporated into these Terms by reference.

Accounts & Security

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You must notify us immediately at info@ongoweightloss.com of any unauthorized access, use, or suspected breach of your account.
  • We reserve the right to suspend or terminate any account, at our discretion, where we suspect fraud, abuse, impersonation, or violation of these Terms.

User Conduct

When using the Services, you agree that you will not:

  • Use the Services for any unlawful purpose, including attempting to obtain medication without a valid, clinically appropriate prescription;
  • Provide false, misleading, or materially incomplete information during intake or consultation;
  • Attempt to access another user's account, data, or health information;
  • Interfere with, disrupt, or attempt to circumvent the security or normal operation of the Services;
  • Upload, transmit, or submit content that is unlawful, defamatory, obscene, infringing, or otherwise objectionable; or
  • Reverse-engineer, scrape, or use automated means to access the Services without our prior written consent.

Intellectual Property

The Services, including all text, graphics, logos, trademarks, software, and other content (excluding Content You Provide, defined below), are owned by or licensed to Ongo and are protected by applicable intellectual property laws. Except as expressly permitted by these Terms, you may not copy, reproduce, distribute, modify, or create derivative works of any part of the Services without our prior written consent.

Content You Provide

You represent and warrant that you own or otherwise have the necessary rights to any information, images, or other materials you submit through the Services ("Your Content"). You grant Ongo a limited, non-exclusive, royalty-free, worldwide license to use Your Content solely as necessary to operate, provide, and improve the Services, consistent with our Privacy Policy and applicable law.

Privacy & Protected Health Information

Our collection, use, and disclosure of your personal information and protected health information ("PHI") is described in our Privacy Policy and HIPAA Notice of Privacy Practices, both incorporated into these Terms by reference. By using the Services, you consent to the processing of your information as described in those policies and represent that all information you provide is accurate.

Electronic Communications & Signatures

You consent to receive all agreements, notices, disclosures, and other communications electronically, and to the use of electronic signatures, records, and consents in lieu of paper. You may withdraw this consent at any time by contacting us at info@ongoweightloss.com, though withdrawal may limit your ability to use the Services. You may request a paper copy of any electronic record by contacting us, and we may charge a reasonable fee for doing so. You should ensure you have the necessary hardware and software (including a valid email address and PDF viewer) to access and retain these communications.

Third-Party Services & Links

The Services may reference, link to, or integrate with third-party websites, applications, or services, including Pharmacy Partners, payment processors, and analytics providers. Ongo does not control and is not responsible for the content, security practices, or policies of any third party. Your interactions with third-party services are governed solely by that third party's terms and policies, and are undertaken at your own risk.

Disclaimers of Warranties

To the fullest extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Ongo does not warrant that the Services will be uninterrupted, timely, secure, error-free, or that any consultation will result in a particular medical or aesthetic outcome.

Limitation of Liability

To the fullest extent permitted by law, in no event will Ongo, its affiliates, officers, employees, contractors, or Providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your access to or use of (or inability to access or use) the Services, regardless of the theory of liability, even if Ongo has been advised of the possibility of such damages.

In no event will Ongo's aggregate liability arising out of or related to these Terms exceed the total amount you paid to Ongo for the Services giving rise to the claim in the twelve (12) months preceding the event giving rise to the liability. Nothing in these Terms is intended to limit liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, or death or personal injury caused by negligence, where such limitation is prohibited.

Indemnification

You agree to indemnify, defend, and hold harmless Ongo and its affiliates, officers, employees, contractors, and Providers from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any content or information you submit through the Services.

Dispute Resolution & Governing Law

18.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-laws principles, except to the extent preempted by federal law or superseded by the mandatory consumer protection laws of the state in which you reside.

18.2 Informal Resolution

Before initiating any formal proceeding, you agree to first contact us at info@ongoweightloss.com so that we may attempt in good faith to resolve the dispute informally.

18.3 Arbitration

Any dispute arising out of or relating to these Terms or the Services that cannot be resolved informally shall be resolved by binding arbitration on an individual basis, administered by American Arbitration Association (AAA), except that either party may bring an individual action in small claims court, and except where applicable state law restricts or prohibits pre-dispute arbitration of healthcare-related claims, in which case this Section applies only to the extent permitted by that law. You and Ongo each waive any right to a jury trial or to participate in a class, collective, or representative action, to the extent permitted by law.

Suspension, Termination & Changes to the Services

  • We may modify, suspend, or discontinue any part of the Services at any time, with or without notice, to the extent permitted by law.
  • We may suspend or terminate your access to the Services at our discretion for any actual or suspected violation of these Terms, suspected fraud, or as required to comply with applicable law.
  • We may revise these Terms from time to time. Material changes will be posted on this page with an updated effective date, and your continued use of the Services after such changes constitutes your acceptance of the revised Terms.

Force Majeure

Ongo will not be liable for any delay or failure to perform any obligation under these Terms where the delay or failure results from any cause beyond our reasonable control, including but not limited to acts of God, natural disaster, labor disputes, acts or orders of government, war, terrorism, epidemic or pandemic, supply chain disruption, carrier or courier delay, or failure of telecommunications or internet infrastructure.

Severability, Waiver & Entire Agreement

  • If any provision of these Terms is held to be invalid or unenforceable by a court or arbitrator of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
  • Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
  • These Terms, together with our Privacy Policy, Refund Policy, HIPAA Notice, and any supplemental terms presented to you at the time of purchase, constitute the entire agreement between you and Ongo regarding the Services and supersede any prior agreements.
